Pakatan fails to get bloc vote on amendments to Prevention of Crime Act

The opposition failed to stop the passing of the Prevention of Crime Act (PCA) at the policy stage after a bloc vote. It is now being debated at the committee stage.
After the vote was taken, 115 MPs agreed for the Bill to be discussed further at the committee stage where every clause will be scrutinised and discussed in detailed, as opposed to 66 who rejected the move.
In a bloc vote, each member indicates his or her vote. Usually, such bills are decided by voice or how loud the “ayes” and “nays” are heard by the Speaker.

This is the first time in this sitting that a division of vote has been called.
Azmin Ali (PKR-Gombak) had requested for a bloc vote after Home Minister Datuk Seri Ahmad Zahid Hamidi completed his winding-up speech and responded to points raised by MPs during debates over the past two days.
The amendments to the PCA were tabled last week in Parliament. One of the amendments provides for up to two years detention without trial.
Currently, the PCA allows the detention of suspects up to 72 days, during which period they should be produced in court at certain stages.
Similar to the old ISA, the proposed amendments exclude the provision of judicial review, except if it is on procedural measures.
A Prevention of Crime Board will also be set up where reports on the detainees are to be made to the board instead of the minister.
Putrajaya came under more fire over the amendments, which have been likened to the return of the Internal Security Act (ISA).
DAP chairman Karpal Singh said the new contents were "no better" than what it was under the ISA while DAP adviser Lim Kit Siang described the amendments as regressive and "an obnoxious piece of legislation".
Civil society, including the Bar Council, have said they were not told nor consulted over the amendments.
As a result, Pakatan Rakyat proposed 10 changes to the PCA, primarily touching on the two-year detention period. - October 2, 2013.

 Development for all

 For far too long, funds for national development under the BN government have always been allocated solely to BN MPs and Aduns.

 As a result, people living in constituencies under PR politicians have been discriminated against and deprived of their right to equal financial allocations for development purposes. This is why Aliran, and other concerned citizens, heaved a sigh of relief when the Penang state government recently decided to change the scheme of things by providing financial allocations to BN Aduns in the state as well.

 We hope the BN government will follow suit in the interest of the people’s welfare, irrespective of their political preference, ethnicity, religion and culture.

 Children’s rights and Malaysian government’s commitment

 The subject of the rights of children in Malaysia came to the fore when police officers questioned a certain group of school children, without the presence of their parents or guardians, pertaining to a controversy surrounding a particular school in the country.

 This subsequently prompted Prema Devaraj to question the seriousness of the Malaysian government, which ratified the United Nations Convention of the rights of the Child in 1995, in protecting and taking care of the welfare of children in the country.

 Spectre of ISA

 The tabling of the amendments to the Prevention of Crime Act (1959) (PCA) by the BN government recently is a cause for deep concern particularly for Malaysians who treasure justice, fairness and democracy.

 P Ramakrishnan argues that the amended PCA has all the trappings of the obnoxious Internal Security Act, particularly its provision of “detention without trial”, that was repealed by the Najib administration in its purported desire to do away with unjust laws in Malaysia.

 Of Pak Samad and creative rebels

 The mistreatment of national icon Pak Samad recently (i.e. the 78-year-old poet-activist was instructed to report to the police station in the wee hours of the morning) by the police over his alleged involvement in flying the Sang Saka Malaya on the eve of the Merdeka Day caught the attention of observer Nicholas Chan.

 He contends that great artists, laureates and thinkers have the tendency to break rules and challenge conventional wisdom in their desire to think out of the box and also in trying to fight for the larger good. Such artistic, intellectual and creative diversity and difference should, he asserts, be celebrated in a democracy.

Stupidity and stupefying statements

 As in most societies, there are the intelligent and the dimwitted. In his personal desire to see an infusion of ‘new blood’ into Umno Baru, former party president Mahathir Mohamad lamented that if Umno Baru leaders remain at the top of the party for far too long, the party would be left with only members who are more stupid than them. This predictably incurred the wrath of some members of the party who insisted that they ain’t stupid.

 But members of the general public may not be easily persuaded and convinced by such denial of the Umno Baru politicians about the very stupidity that was assigned by Mahathir. Take the recent statement by deputy Finance Minister Ahmad Maslan on the recent fuel hike: “The government did not raise the price of petrol, and had merely reduced the subsidy.” If this doesn’t reinforce the suspicion that certain Umno Baru politicians are quite intellectually challenged, we don’t know what will.

 If the above isn’t enough to convince you, try this one: Deputy Science, Technology and Innovation Minister Abu Bakar Mohamad Diah recently declared that the Lynas rare earth plant in Gebeng, Kuantan is “as safe as a kicap factory” – which predictably invited biting criticisms and condemnation from civil society groups.

 There are, as you are fully aware, lots more examples of stupidity in our midst in recent times, but the above is sufficient to remind us that leaving the future of our beloved country entirely in the hands of such supposed leaders can be nervewracking and risky. We will have to take part in the democratic process in various ways to ensure that our collective future doesn’t become irreversibly bleak.

Folks the conclusion first : Malaysia Airlines is in trouble again. There is only one way to turn MAS around - stop the stealing.  People who have been reading old books about Wall Street raiders are now planning to rip off MAS.

Here is the story. MAS is actually quite a jewel in the crown. Here are some really positive things about MAS. 

• MAS provides excellent service
• an excellent fleet of airplanes
• an almost 100% unblemished safety record
• good routes and most vitally, 
• strong passenger loads.  

Here is more about MAS from BK Sidhu of The Star :

• airline reported its highest ever load factor of 84.3% for June 
• carrying 47,000 passengers every day 
• Last year daily number of passengers was 37,000.
• flies 17% more flights per day 
• managing 340 flights per day, 60 destinations. 
• “RM3bil cash in the bank
• rural routes being fully subsidised by government

Other airlines around the world which enjoy the same ingredients are able to make profits. 

May I add something else - MAS also has a near monopoly access over the most favourable airport services and ground handling services in Malaysia plus strong Government support.

And yet MAS is in trouble again. They are making losses.  Now they are saying that they want to sell off MAS.  

You mean this is what all the 'con-sultans' can come up with? This is the GLC management expertise? Sell off MAS? This is the "nenek tua" style of management again.

Folks, do you know that Malaysian Airlines share price is now down to just 33 sen a share? A roll of toilet paper costs more. We are talking about our national airline. Apa sudah jadi?

The corporate raiders are now drooling at MAS. Old crooks have learnt new tricks. The stealing is going on. 

Imagine you were a crook. Then you were put in charge of this huge and wonderful asset called MAS. You cannot steal the airplanes - they are too big. Someone else has already stolen the food catering business. 

So what would you do? How would you steal? It is a listed company. You push down the prices of the shares. You push it down to almost worthless paper. You float all sorts of negative news about MAS as well. 

Then you call up your fellow crooks. They come in as "white nights" and say 'We have come to save you. We will buy over MAS and save it". 

So they buy over MAS at 33 sen a share or less. Then they break up the company and sell off its core businesses and assets. This is called asset stripping.  

The accounts say MAS has 56 sen worth of assets per share. The share price is 33 sen per share. Each share therefore already has a 23 sen 'buta premium'. 

Or they can push the share prices down even further - to toilet paper level. At such low prices, of course they can buy it cheap and then "miraculously" boost the share price up again. They will make some bombastic announcements. The share price goes up, maybe even doubles or triples. Or more.  
Then they unload their shares, make a neat profit, pay themselves off and exit the scene. MAS will fly into more turbulence again. Then another rescue package will be put in place yet again.

Somewhere in between all these rescue plans in the diagram above MAS once paid RM38 for six bottles of mineral water !! You can buy Spritzer at Mydin for about RM15 per six bottles.

Making things worse was the fact that MAS' highly profitable food catering business was sold to Slumberjack's brother. From making huge profits, MAS made immediate losses on food because now they had to buy the food from Slumberjack's brother. What a fantastic business model. This is called the "Nenek Tua Business Model". It is just a few steps ahead of the "Proton School of Management."

This is what the Star says - supply contracts overpriced, buying more aircraft spares than they need, bloated senior management (paid RM50,000 - RM80,000 a month). Its plain rock and roll at MAS.

At one time MAS even bought expensive art works - paintings of fat women by some Mat Salleh painter. That was some fetish.

How does MAS survive through all this mismanagement, incompetence, restructuring, stealing, thievery and stupidity?

The answer is simple : YOUR MONEY. Taxpayer's money - that bottomless pit of taxpayers funds which is the source of stealing and cheating for the connected and the powerful in this country.

Hardly any one of them earns an honest income. Their income comes from rerouting taxpayers money through hare brained schemes, hare brained projects and through the GLCs.Companies go bust, taxpayers lose money but somehow the same money ends up in their pockets.
Kalau tak tahu nak jaga bisnes jual sajalah MAS kepada Tony Fernandez. I am sure he can turn around MAS.  Or ask someone else more capable to run things. It is not difficult at all to turn around such heavyweight companies. They have plenty of strengths.

As socalled leaders, it is timely that all of them exhibit their personal documents to justify them to be leaders etc.

All key leaders must be born in the respective state to hold office and present their birth certificates and DNA to remain in office or go to jail for such crimes.

Now two GLC bigwigs said to have fake degrees

Top executives of two government-linked companies have now been accused of having obtained fake degrees from universities that an opposition MP described as "degree mills".

DAP's Serdang MP Ong Kian Ming, who made similar accusations against a couple of cabinet members in the past, made this claim today against two high-ranking board members.

Ong said the websites of the companies said one of them had obtained a doctorate from Warnborough University in the United Kingdom, while the other had obtained a Master's degree from Preston University in the United States.

Preston University is the same university that Ong previously accused Human Resources Minister Richard Riot of having obtained a fake Master's degree from, an allegation that Riot has denied.

Sabah Bumi entrepreneurs also successful – Muhyiddin

KOTA KINABALU: Bumiputera entrepreneurs in Sabah are as successful as their peers in other states, Deputy Prime Minister Tan Sri Muhyiddin Yassin said.
He added that through the Barisan Nasional (BN) government’s efforts, the living standards of people in Sabah, especially the Bumiputeras, have seen much growth, he said when officiating at a forum for Bumiputera entrepreneurs here yesterday.
The improvement is reflected in the increase in the average household income in Sabah from RM3,102 a month in 2009 to RM4,013 a month in 2012.
This showed an increase of 29.4 per cent with an annual growth of 8.6 per cent, Muhyiddin said, adding that the average monthly income had also increased by 22.7 per cent from RM3,803 in 2009 to RM4,668 in 2012.
In the case of the rural areas, the average monthly income increased by 33.8 per cent from RM2,177 in 2009 to RM2,913 while the poverty rate in Sabah had decreased from 19.7 per cent in 2009 to 8.1 per cent in 2012.
“This is the data that we have recorded and not data that is pulled out of the air by economists. So if there are quarters who go around claiming that there is no economic growth in Sabah, we can prove them wrong as we have the facts and figures to show differently,” he said.
“Congratulations to the Chief Minister of Sabah, Datuk Seri Musa Aman, for the success in making life better for the people in the state. Sabah will continue to develop and progress under Barisan Nasional,” Muhyiddin added.
He pointed out that the government’s success in reducing and eradicating poverty was achieved through the implementation of specific programs to assist the poor and low income earners to generate a higher income.
Among the programs were 1AZAM, Agropolitan development, Mini Estet Sejahtera, commercial livestock breeding and agriculture as well as micro credit loans, he said.
For Sabah, the federal Government had allocated RM12.2 billion under the 10th Malaysia Plan for the implementation of various programs, including rural infrastructure, educational programs and housing assistance under the Government Transformation Program (GTP), he said.
Muhyiddin added that this had indirectly opened up more opportunities for Sabahan entrepreneurs to be more active in economic activities.
“Under the GTP programs Sabah has achieved successes in social development and infrastructure in the state, including the construction and upgrading of 1,270 kilometres of rural roads and the supply of electricity to an additional 41,443 houses in the rural areas since 2010.
“As steps to assist the low income group to generate income, a total of RM293.5 million has been allocated to Sabah under the 1AZAM program. As of June this year, a total 27,540 low income individuals in Sabah have received assistance under the program making them the largest number of recipients.
“The government realizes that the achievement of the Bumiputera entrepreneurs is not at what we expect it to be as there is still disparity in the aspect of economical asset ownership and the level of revenue,” Muhyiddin added.
According to him, among the challenges faced by new entrepreneurs in Sabah was the limited market and they have to join forces with their counterparts in Peninsular Malaysia in order to be able to compete at local and global markets.
To this end, Bumiputera entrepreneurs in Sabah venture out of the small markets and establish smart partnerships with their non-Bumiputera peers so that they can explore bigger markets.

Kedah Menteri Besar Mukhriz Mahathir has shown signs of a vengeful menteri besar, out to punish the Chinese for voting against BN, said Seputeh MP Teresa Kok.

In a press release today, Kok said Mukhriz's statement that he would not entertain any requests from Chinese schools in the Kedah was "unbecoming of a menteri besar".

"Mukhriz must accept that the voters have the right to choose whom they want to support and he must realize too that Chinese voters too are tax payers.

"It is therefore most unfair, undemocratic and unacceptable to discriminate against the Chinese community and Chinese schools," she said.

On September 24, Mukhriz told reporters in Shah Alam that his administration will concentrate on national schools because he could not ignore those who voted BN back into power in Kedah.

"I want to be fair but I am also human. In the end, I am forced to help those who have helped me before.

"If the state can afford to, then I will help others," he said, reportedFree Malaysia Today.

Kok pointed out that this was not the first time that Mukhriz had made known his stance on vernacular schools, citing how he had called for such schools to be replaced with a single-stream schooling system to foster unity. 

"Let me tell him that language or the vernacular is not a cause of racial polarization but unfair government is. 

"And politics of vengeance will certainly be a big cause," said Kok.

KUCHING (Sept 24): A group of Sarawakians mulls suing the British Government for failing to return sovereignty to the state before the formation of Malaysia, 50 years ago.

Recent declassified British colonial documents appear to support the group's claims that the British colonial office colluded with Malaya leaders to secretly contrive the sovreignty of British Borneo to Malaya.

“The British were masterminds and strategists. Despite massive opposition to the Malaysia Plan, they denied Borneo colonies rights to self-determination,” said Lina Soo, who compiled all these historical facts and information into a book.

Entitled of 'Sarawak: The Real Deal', the 124-paged book containing 10 chapters highlights Sarawak's history, includes selected colonial documents, anti-Malaysia campaign and other information on the formation of Malaysia.

The sub-heading of the book reads 'How a Kingdom was betrayed in an intrigue of trickery, coercion an subterfuge'.

The last few pages in Chapter 10 centres on when Singapore left the federation of Malaysia in 1965 to become an independent nation. Sarawak and Sabah were warned by Britain not to try to follow suit.

“The book is to give Sarawakians an informed account based on both Sarawak and British official sources of the events leading to the formation of Malaysia,” Soo told reporters at the book launch today.

Soo, who has been campaigning for Borneo Agenda in the past few years, said because of British’s failure to honour the United Nation decolonisation process, it led to serious consequences for both Sarawak and North Borneo (now Sabah).

“Sarawak and Sabah were plundered of their oil and resources for 50 years and both states became the most impoverished parts of Malaysia,” she said, adding that a group of people, including a few lawyers, was preparing the legal documents to file the suit.

She said the main objective is to determine whether Sarawak voluntarily join the federation to form Malaysia, and whether Sarawak can federated with other nation before gaining sovereignty.

In addition, she said the case would seek compensation from the British for its violation of human rights and the people’s unalienable right to independence under international law.

The 54-year-old housewife, who stood in the last general election under State Reform Party’s (STAR) ticket, is also calling for volunteers and contributors to come forward. She plans to raise £50,000 (RM256,593) to prepare researched documentation and to acquire legal opinion.

Registered supporters who pay a registration fees of RM50 have been promised a share of the compensation money should they win the case.
